These General Terms of Service (Terms) apply when you access or use any app, website, product, or other service offered by Retrac Labs, LLC (Retrac Labs) (each, a Service). Please read them before using a Service.
1. How these Terms work
A Service may have additional terms, rules, or notices that describe features or requirements specific to it (Service Terms). Review the Service Terms for each Service you use. If Service Terms conflict with these Terms, the Service Terms control for that Service, except where applicable law requires otherwise. The Privacy Policy and any Service-specific privacy notice explain data practices; they are not part of these Terms unless expressly stated.
2. Eligibility and accounts
You may use a Service only if you meet its stated age and eligibility requirements and may legally agree to these Terms. Some Services are not intended for children. A Service that permits children may require a parent or guardian to participate or consent. Check that Service's Terms and privacy notice for its age rules.
If a Service requires an account, provide accurate information, protect your sign-in credentials, and tell us through that Service's support channel if you suspect unauthorized access. You are responsible for activity on your account to the extent permitted by law.
3. Acceptable use
Use the Services lawfully and respect others. Do not misuse a Service, interfere with its operation or security, access accounts or data without permission, introduce harmful code, or use a Service to violate another person's rights. Do not copy, scrape, reverse engineer, or resell a Service except as the law permits or we expressly authorize. A Service may include additional conduct rules.
4. Your content
Some Services let you submit, upload, or share content. You retain any rights you have in your content. You give Retrac Labs a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, and process that content only as needed to operate, maintain, improve, and provide the relevant Service, as described in its Service Terms and privacy notice. You are responsible for having the rights needed to submit your content and for its legality. Service-specific terms may explain sharing, visibility, and removal options.
5. Our materials and feedback
Retrac Labs and its licensors own the Services and their software, designs, branding, and other materials, excluding your content. We give you a limited, revocable, nontransferable right to use each Service as intended while you comply with these Terms. If you send feedback, we may use it without obligation to you, but we will not identify you publicly without permission unless the law allows it.
6. Purchases and third-party services
A Service may offer paid features. Its checkout flow or Service Terms will state prices, billing, renewal, cancellation, and refund rules before purchase. Third-party products, links, or integrations may have their own terms and privacy policies. We are not responsible for third-party services except as required by law.
7. Changes, suspension, and termination
We may update, suspend, or discontinue a Service, or restrict access where reasonably needed for security, legal compliance, maintenance, or misuse. You may stop using a Service at any time and may close an account using the options described for that Service. We may suspend or end your access if you materially violate these Terms or Service Terms, subject to applicable law. Any rights or duties that by their nature should continue will survive termination.
8. Disclaimers and liability
We aim to provide reliable Services, but they may be unavailable or contain errors. To the extent allowed by law, Services are provided 'as is' and 'as available,' without warranties not expressly stated for a particular Service. Nothing here limits rights or remedies that cannot legally be limited. To the extent allowed by law, Retrac Labs is not liable for indirect, incidental, special, consequential, or punitive damages arising from a Service. Any additional limits specific to a Service will appear in its Service Terms.
9. Changes to these Terms
We may revise these Terms as our Services or legal requirements change. We will post the updated version with a new effective date and give any additional notice required by law. Continuing to use a Service after revised Terms take effect means you accept them where the law permits. Review the Service Terms as well; they may change separately.
10. Governing law
Colorado law governs these Terms and disputes about them, without regard to conflict-of-law rules, except where applicable consumer law gives you rights or protections that cannot be waived. The Service Terms may identify additional dispute procedures that apply to that Service.
